1. Why these rules exist
1.1. We restore faces from your originals and place them in an imagined but plausible setting of their era. We bring memories to life — not people. These rules protect the people in the photos, you and us; they form part of the Terms of Service and apply to the Free Restoration too.
1.2. Only persons aged 18 or over may order.
2. What we accept
2.1. Digital copies (photos, scans) of old family photographs you have the right to use: you own the print or file and no photographer's rights are infringed — or the photo is more than 70 years old and has never been published.
2.2. Living Depicted Persons — only with their consent to the processing of the photo and the creation of an Artistic Reconstruction. The exception is you.
2.3. Children (under 18) — only if you are their parent or guardian or have that person's consent, and only in a family context.
2.4. Deceased persons — if you are a family member and, as far as you know, none of those entitled to consent (children, widow or widower; if none, parents, brothers, sisters) objects.
2.5. The Description for each photo must be truthful: name, years, region, occupation, context and the "living/deceased" mark. The scene is built from it.
3. What we do not do
We refuse an Order, in whole or in part, if the Source Materials, Description or request involve:

| 6 | Photos obtained unlawfully: stolen, or copied from someone else's private pages without permission. |
| 7 | Requests to deceive, harass, defame, spread disinformation, fabricate "evidence" of events that did not happen, or forge documents. |
| 8 | Synthesis of voice or speech — "make him say something". We add only 2.5D camera movement and light animation without speech. |
| 9 | Anything unlawful in Ukraine or in your country. |
We also do not accept original prints by post — digital copies only.
4. How we check
4.1. Every Order passes two filters: the automated safety filters of our AI provider (OpenAI) and a human review by the Studio. We look at the photos, the Description and the context of the request.
4.2. We may ask clarifying questions before starting — for example, about your family relationship to a deceased person — or ask you to confirm a living Depicted Person's consent.
4.3. The Similarity Check (automated comparison of the restored face with the original) is not content moderation; how it works is described in the Privacy Policy.
5. If we refuse
5.1. We tell you by e-mail or Telegram and, where possible, offer to complete the Order without the problematic photo.
5.2. We refund the part not performed under the Refund Policy — in full if work has not started. Source Materials are deleted within the periods set in the Privacy Policy.
5.3. We may keep a record of the refusal (Order number, date, ground) for 3 years, together with the other Order data.
6. Your obligations once you receive the Deliverables
6.1. The Deliverables are an Artistic Reconstruction, not a document. They carry an AI label: title cards at the start and end of the Film, a caption on the Delivery Page, a caption in the Album and on the back of the Canvas Portrait, and metadata in the files. Do not remove them when you share.
6.2. When you post the Deliverables on public platforms (Instagram, TikTok, YouTube, Facebook), switch on the "made with AI" label.
6.3. Use the Deliverables for personal, non-commercial purposes: within the family and on personal social pages. Do not use them to deceive, harm, defame, sexualise or manipulate politically. Commercial use requires a separate agreement.
7. Reporting misuse
If you see our Deliverables used to deceive or cause harm, or your own image processed without your consent, write to hello@vidlunnya.com with a link, a screenshot and a short explanation. We reply within 5 business days, may close access to the Delivery Page and delete the materials, and cooperate with the authorities where the law requires it.
8. Consequences of a breach
8.1. If you breach these rules or the warranties in the Terms of Service, we may cancel the Order and close the Delivery Page.
8.2. The part of the Order already performed before your breach came to light is not refunded; the part not performed is. This does not limit your mandatory rights as a consumer.
8.3. You reimburse the Studio's reasonable, documented losses from third-party claims caused by a breach of your warranties, within reasonable limits, as provided in the Terms of Service.
8.4. Where the law requires it, we cooperate with law-enforcement authorities.
